Blockchain Certification Services – Terms & Conditions

1. Scope of Blockchain Certification Services

These terms apply to the issuance, storage, verification, and maintenance of blockchain-based digital certificates issued through the Crypken platform. Blockchain certificates may include, but are not limited to:

• Educational and professional achievement certificates
• Training and course completion records
• Event participation and attendance credentials
• Badal (Hajj Deputisation) certification
• Quran recitation and religious knowledge certification
• Custom organisational or institutional certificates

2. Nature of Blockchain Certificates

• Immutability: Once a certificate is minted and written to the blockchain, it becomes a permanent and tamper-proof record. It cannot be altered, modified, deleted, or withdrawn.
• Non-Revocability: Crypken does not support certificate revocation or expiry mechanisms unless explicitly stated and technically supported in the certificate issuance process.
• Public Accessibility: Blockchain certificates and associated metadata may be publicly viewable on distributed ledgers unless privacy settings or encryption mechanisms are explicitly applied.

3. Certification Request and Data Accuracy

• You are solely responsible for the accuracy, completeness, and authenticity of all data submitted for certification.
• Crypken does not verify the truthfulness or validity of submitted data unless explicitly contracted to do so under a separate verification service agreement.
• Any errors, omissions, or false information in the certificate are your responsibility. Once minted, corrections are not technically possible.
• Crypken disclaims all liability for erroneous, misleading, or fraudulent data included in blockchain certificates.

4. Certification Authority and Recognition

• Crypken acts as a technical certification service provider but does not act as an accreditation body, regulatory authority, or legal certifier unless explicitly stated.
• The recognition, acceptance, or legal validity of blockchain certificates issued by Crypken is not guaranteed and may depend on the policies of third-party institutions, employers, regulators, or governments.
• Crypken is not responsible if a certificate is not accepted or recognised by any third party.

5. Pricing and Minting Fees

• Blockchain certificate issuance is subject to minting fees, blockchain transaction fees (gas fees), and service fees.
• Fees are payable upfront unless otherwise agreed in writing.
• Blockchain transaction fees may vary depending on network congestion and are non-refundable.
• Crypken reserves the right to revise minting fees and certification pricing at any time.
• Once a certificate has been minted, fees paid are non-refundable, even if the certificate contains errors or is not used.

6. Blockchain Infrastructure and Availability

• Blockchain certificates are minted on blockchain networks selected by Crypken, which may include public, private, or consortium blockchains.
• Crypken does not guarantee perpetual blockchain network availability, as it relies on third-party blockchain infrastructure.
• If a blockchain network becomes unavailable, deprecated, or discontinued, Crypken is not liable for loss of access to certificates, but will make reasonable efforts to provide migration or archival solutions where commercially feasible.

7. Security and Cryptographic Integrity

• Blockchain certificates are cryptographically secured using industry-standard hashing and encryption techniques.
• Users are responsible for securely storing private keys, wallet credentials, and access credentials associated with their certificates.
• Crypken is not responsible for loss, theft, or unauthorised use of private keys or wallet credentials.
• In the event of a cryptographic vulnerability or blockchain exploit affecting certificate integrity, Crypken will notify affected users but is not liable for damages resulting from such events.

8. Verification and Public Access

• Crypken provides verification tools to allow third parties to independently verify the authenticity of blockchain certificates.
• Verification services may be made available via web-based portals, APIs, or QR code scanning mechanisms.
• Crypken does not charge fees for basic certificate verification but may introduce premium verification services in the future.
• Crypken does not guarantee that third-party verification services will be compatible with all systems or platforms.

9. Intellectual Property in Certificate Content

• You retain ownership of the content submitted for certification (such as names, achievements, and descriptions).
• By submitting content for certification, you grant Crypken a perpetual, irrevocable, worldwide licence to store, display, reproduce, and distribute the certificate content on the blockchain and through verification platforms.
• You warrant that you have the legal right to submit all content and that such content does not infringe the intellectual property rights of any third party.
• Crypken retains ownership of all blockchain certificate templates, designs, verification systems, and platform software.

10. Data Protection and Privacy

• Personal data submitted for blockchain certification will be recorded on the blockchain, which may be publicly accessible.
• Blockchain records are permanent and cannot be deleted or modified to comply with data deletion requests (e.g., the "right to be forgotten" under GDPR or similar laws).
• By requesting blockchain certification, you acknowledge and accept that your data will be stored on an immutable ledger.
• Where privacy-preserving techniques (such as hashing or encryption) are applied, Crypken will inform you at the time of certification.

11. Compliance and Regulatory Matters

• You are responsible for ensuring that your use of blockchain certification services complies with all applicable laws and regulations in your jurisdiction.
• Crypken does not guarantee that blockchain certificates will meet regulatory or accreditation requirements in any jurisdiction.
• If regulatory authorities require changes to certification practices, Crypken reserves the right to modify or discontinue services with reasonable notice.

12. Limitation of Liability for Blockchain Certificates

To the fullest extent permitted by law:

• Crypken is not liable for any loss, damage, or harm arising from the use, misuse, non-acceptance, or non-recognition of blockchain certificates.
• Crypken is not liable for blockchain network failures, transaction delays, or minting errors beyond its reasonable control.
• Crypken's total liability for any claim arising from blockchain certification services shall not exceed the amount paid by you for the specific certificate in question.
• Crypken is not responsible for financial loss, reputational damage, or other indirect or consequential damages arising from certificate-related issues.

13. Indemnity for Blockchain Certificates

You agree to indemnify and hold harmless Crypken from and against any claims, losses, damages, liabilities, or expenses arising out of:

• Inaccurate, false, or misleading information submitted for certification
• Unauthorised use or distribution of blockchain certificates
• Your breach of these Terms or applicable laws
• Third-party claims related to the content or use of your certificates

14. Suspension and Termination of Certification Services

Crypken reserves the right to suspend or terminate blockchain certification services if:

• Fraudulent, false, or misleading information is detected
• There is a breach of these Terms
• Legal or regulatory requirements necessitate such action
• Payment obligations are not fulfilled

Termination of services does not affect certificates already minted on the blockchain.

15. Amendments to Blockchain Certification Terms

Crypken may amend these blockchain certification terms at any time. Changes will apply to new certifications issued after the amendment date. Previously issued certificates remain governed by the terms in effect at the time of issuance.

16. Governing Law and Jurisdiction for Blockchain Certificates

These blockchain certification terms shall be governed by and construed in accordance with the laws of Malaysia.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
